
Why the Second Amendment Matters

There can be no doubt that the framers of the US and Texas Constitutions understood the inherent right of the people to keep and bear arms. As well, this was not some “privilege” to be adjudicated by the whims of the government. There have been many arguments about what constitutes the “Militia.” The answer is simple: all of us, adult citizens.
As well as having the right to keep and bear arms, it was also, as is stated, a responsibility of the people to provide security for the State (nation). In other words, a citizen is the first line of defense for their own security, and that of the State.
Of course there have been legal challenges to the Second Amendment and the US Supreme Court has issued clear rulings in support of the Second Amendment. There are the cases Heller v DC (2008) and McDonald v Chicago (2010); narrow 5-4 decisions, that reinforced the standing and constitutionality of the Second Amendment as the law of the land, and against state and local municipal infringements.
However, that has not stopped progressive socialist leftists from continuing their assault against the Second Amendment. Just recently we had the State of Colorado legislature pass bills in their House and Senate that ban semi-automatic pistols, rifles, and shotguns . . . anything with a detachable magazine. This past week, the Supreme Court heard the case of Mexico seeking billions of dollars from American gun manufacturers blaming them for transnational narco-criminal terrorist violence rather than Mexico’s failure to defeat the cartels. Sadly we have some 12 Democrat State Attorney Generals and the US First Circuit Court of Appeals supporting a foreign country in a blatant attempt to undermine the Second Amendment right of legal, law-abiding citizens.
Let’s not fool ourselves: it was just in 2021’s Texas legislative session that constitutional carry passed in the Lone Star State. A Republican Party of Texas legislative priority that even the Lieutenant Governor, Dan Patrick, did not support. Constitutional carry means that a legal, law-abiding citizen who passes the ATF Form 4473 background check can constitutionally carry their firearm. Now, I, for one, advocate for weapons training and completing the concealed carry instruction which will allow one to be able to carry in a reciprocal state and to carry in certain public places. However, a citizen has the right to self-defense and does not require a “Mother, May I?” from the government.
Under that backdrop, tomorrow, Tuesday, March 11, I will join others at the Texas State Capitol for Gun Owner’s Day. One of the concerns that I — and many others — have is that with the recent idiocy of the Texas State House mandating co-chairmanships to leftists, we could see a purposeful sabotaging of gun rights legislation in Texas.
The legislative filing deadline is coming upon us at the end of this week. In a legislative session that is just 140 days long, we are already near the 55 day point.Â
Some of the critical issues are to put an end to Red Flag gun confiscation laws, ending Gun Free Zones (GFZs), providing better civil liability protections for gun owners, eliminating sales tax on firearms and ammunition, and ending the federal government prosecution against the sale of Texas manufactured weapon suppressors. We still have the ATF punishing Texas manufacturers who sell suppressors to Texans, continuing to force them to abide by the insidious tax stamp mandate, which can delay suppressor ownership anywhere from 4-8 months.

Why does the Second Amendment matter? History teaches us a very simple lesson, armed people are citizens who can defend and protect life, liberty, and property. Disarmed people are subjects. Every totalitarian regime, dictator, autocrat, and despot has first disarmed the people in order to subjugate them, and it is no different with these postmodern progressive socialist, Marxists, who, even here in Texas, seek the same. It is unconscionable to me why any sane elected official would seek to share power with these tyrants.
